Sont-ils report\u00e9s et pay\u00e9s\u00a0?<\/span><\/span><\/em><\/strong><\/span><\/p><p><em><span dir=\"auto\" style=\"vertical-align: inherit;\"><span dir=\"auto\" style=\"vertical-align: inherit;\">Report du solde des cong\u00e9s pay\u00e9s<\/span><\/span><\/em><\/p><p><span dir=\"auto\" style=\"vertical-align: inherit;\"><span dir=\"auto\" style=\"vertical-align: inherit;\">Les jours de cong\u00e9 pay\u00e9s non pris ne peuvent \u00eatre report\u00e9s \u00e0 la p\u00e9riode suivante, ils sont <\/span><\/span><strong><em><span dir=\"auto\" style=\"vertical-align: inherit;\"><span dir=\"auto\" style=\"vertical-align: inherit;\">perdus<\/span><\/span><\/em><\/strong><span dir=\"auto\" style=\"vertical-align: inherit;\"><span dir=\"auto\" style=\"vertical-align: inherit;\"> , sauf dans les cas ci-dessous\u00a0:<\/span><\/span><\/p><ol><li><span dir=\"auto\" style=\"vertical-align: inherit;\"><span dir=\"auto\" style=\"vertical-align: inherit;\">Au retour d&#8217;un cong\u00e9 de maternit\u00e9 ou d&#8217;adoption (article L3141-2 du Code du travail), les jours de cong\u00e9 pay\u00e9s acquis ne sont pas perdus (contrairement au cong\u00e9 parental o\u00f9 ils sont perdus, Cour cass.soc. 28 janvier 2004, n\u00b0 01-46314, BC V n\u00b0 32).<\/span><\/span><\/li><li><span dir=\"auto\" style=\"vertical-align: inherit;\"><span dir=\"auto\" style=\"vertical-align: inherit;\">Cong\u00e9 maladie (professionnel ou non) ou accident du travail, ayant d\u00e9but\u00e9 \u00ab avant \u00bb le d\u00e9but de la p\u00e9riode de cong\u00e9 pay\u00e9 =&gt; les jours de cong\u00e9 pay\u00e9 sont report\u00e9s (Cour cass.soc. 24 f\u00e9vrier 2009, n\u00b0 07-44488, BC V n\u00b049)<\/span><\/span><\/li><li><span dir=\"auto\" style=\"vertical-align: inherit;\"><span dir=\"auto\" style=\"vertical-align: inherit;\">Dans le cas d&#8217;un am\u00e9nagement annuel du temps de travail, la convention d&#8217;entreprise peut pr\u00e9voir le report du solde des jours de cong\u00e9s pay\u00e9s (article L 3141-22 du Code du travail).<\/span><\/span><\/li><li><span dir=\"auto\" style=\"vertical-align: inherit;\"><span dir=\"auto\" style=\"vertical-align: inherit;\">S\u2019il existe un accord formel employeur\/employ\u00e9 =&gt;
